Crown Point Parkway Neighbors Face Off Over Fireworks, Christmas Display

No decision yet in court case

 

 

Two next-door neighbors on Crown Point Parkway argued their cases in Berea Municipal Court Wednesday over a Christmas display and a lighting ceremony with fireworks on the cul-de-sac street.

Kevin Roberts is seeking damages and asking that the backyard fireworks show be shut down permanently.

"I want to send a clear message that this (fireworks display) is illegal and never to do it again," Roberts said.

Dan Hoag, who organizes the lighting display and sets off the fireworks in his yard, said the lawsuit is the result of a "vendetta" Roberts has against his neighbors.

"Regardless of the fireworks, we're not going to stop decorating," Hoag said.

Magistrate Lawrence G. Sheehe Jr., who heard the case in Small Claims Court, did not issue a ruling on Wednesday, saying he would review the facts and render a decision soon.

"Clearly, this (dispute) hurt," he told both men. "It hurt everyone involved."

Crown Point Parkway has been featured in local and national news for its street-long lighting display. The lights and yard decorations draw thousands of visitors to the cul-de-sac each holiday season.

Hoag, the main organizer of the display for the last 20 years, launches the season with a lighting ceremony, including a seven-minute fireworks show, on Thanksgiving evening.

Between 600 and 800 people gather on the street, which is blocked off with permission from Strongsville officials.

Roberts is seeking $3,000 from Hoag, alleging the fireworks have damaged his property and that his sister, Cheryl, was harassed and heckled when she tried to drive through the crowd two years ago.

"I went as slow as possible . . . through the crowd," Cheryl Roberts testified. "People were swearing at me, banging on my car." 

The ordeal upset her and her dog, she said.

Kevin Roberts also said he got an estimate of $305 from his insurance company to clean debris from the fireworks from his gutters, roof, lawn and car.

And he said a permit to discharge fireworks was never issued.

Hoag argued that Cheryl Roberts "deliberately" drove through the crowd of people, and neighbor Dan Paliwoda testified that he witnessed no heckling.

"I assisted in her trying to get out (of the driveway)," Paliwoda said.

Roberts' other sister, Donna Medlin, testified on Hoag's behalf, saying her brother vowed to live in the Crown Point Parkway house, which originally belonged to their father, for the rest of his life "just so he can make the neighbors' lives as miserable as possible."

Kevin Roberts acknowledged that is true.

"They made my father's life miserable. I want it to stop, or his (Hoag's) life, I want to be miserable too," Roberts said.

Hoag said he and Roberts used to be friends, and that Roberts helped wire the street for the lighting display.

But Roberts' late father apparently began to dislike the lights and the crowds, to the point he was charged with cutting Hoag's electrical wires in about 2002. 

Hoag said the late Mayor Walter Ehrnfelt finally called in the elder Roberts and warned him he would be cited if he didn't stop calling police to report noise, crowds and other issues on the street.

Hoag said he got verbal permission from Mayor Tom Perciak on Nov. 15 to set off fireworks this past Thanksgiving.  

And he said he would have gladly cleaned up debris from Roberts' yard if he'd known it was a problem.

"I'd write him a check tomorrow for $300," Hoag told the magistrate. "There's no reason to go through all this."

Sheehe said he thinks it is "wonderful" that the residents on the street take donations from visitors and give them to a local charity or needy family, including more than $4,000 last month to the family of a Parma boy fighting a brain tumor.

He said he would review the testmony and evidence both men entered and make a decision soon.

Wow,how sad that Kevin Roberts readily admitted what his sister testified to in court-that this is merely a vendetta against his neighbors because he is miserable & wants everyone else to be. He really needs psychological help and a new place to live. Something tells me he's not going to let this go until he has a breakdown/meltdown & I sure hope no one gets hurt further as a result of his behavior. It's got to be horrible to live in a neighborhood with someone so spiteful for no good reason. May God have mercy on you Kevin & I hope you find some peace within yourself to heal your past grievances & find some joy in your life.

Very sad that Kevin has chosen making "the neighbors' lives as miserable as possible" as his apparent #1 goal in life. It also sounds a little scary - like someone who could "go postal". I think he needs help to get past this or he will die a very unhappy man. And, the best thing for him to do is contact a realtor and move - for his own peace of mind and those on the street.
It also doesn't sound like there was any damage at all. Just complaining about some debris from the fireworks. But, how much could there have been? I hope he had pictures. If not, I would tend to doubt the amount of debris he was claiming, as this guy was quick to video the fireworks being set off so he definitely would be one to take pictures of ANY little debris in his yard.
And, I'm having a hard time imagining people who come out to view Christmas decorations as being a rowdy, swearing, violent crowd.

I agree I hope no one gets hurt, but I think it is the police and maybe corrupt mayors that allow some folks to ignore laws that are there to protect us. It’s got to be horrible to live in a neighborhood where you can’t even have your family over for a peaceful holiday. Regarding the sisters testimony anyone who would go out of their way to testify against a family member is clearly spiteful, disgruntled and has a vendetta. I hope everyone can each find peace and be respectful of each other.

Steve AKA Kevin, if you truly desire peace,then end your vendetta. Either move or get some psychological help to understand your need/desire to "punish" others for your own distorted reasons. That is the only way there will be peace. Do you realize how much space that anger takes up & controls your life & how miserable it is making MAINLY YOU. Yes,you see,the others do have lives & go on & you are only a small part of theirs-maybe that's what bothers you-you are lonely & hateful and that will only continue unless you move or get the help you so richly need. I pray for you that you face the hurt that is causing this behavior & find a way to come to terms with it. Your neighbors sound like they can be very forgiving people-they have not bashed you or attacked you personally in the media(stating factual truths of events is not bashing),which they could have if they were the awful people you'd like others to believe. They obviously care enough about you & are concerned for your mental health/well being. Please seek out & ask forgiveness or at least help for yourself. You will be very surprised at how compassionate people can be& how direct communication can melt away misunderstandings or hatred. Forgiveness is so healing for both parties-it truly is a gift you give yourself.

Steve or Kevin (whoever you are I really couldn't care less), I would LOVE to sit down and explain the FACTS to you. You don't have a clue. We are most certainly not a 'lynch mob' nor 'ignorant bullies'. And your comment about hoping Kevin does have a firearm is both concerning and a disturbing statement on your part. The people on Crown Point do not 'have hate' towards Kevin. We have as much right to freedom as he does to be happy. We also have the right to NOT be videotaped on a daily basis as do our children, grandchildren, and anyone else who happens to walk past his house.
I would like to know what backround you and Debbie (comments below) have in mental health. I have worked in special education for 15 years and when a grown man makes a statement like, "I will spend the rest of my life making life miserable for everyone else on the street" he has a problem that should be addressed.
We are also all Americans and more patriotic than many. We are all for open forums and opinions but common sense tells me that an opinion should be backed up with actual facts.

Steve, I am proud of you and your comments. I wonder how many of these complainers actually live on that street. This has gotten well out-of-hand. People making comments about "having to get mental help", "ask forgiveness", etc. Forgiveness for what? Folks, this man/family have the right to disagree and complain if he wants. While Faith’s comment is true, in the article above, Mr. Roberts is also quoted as saying "They made my father's life miserable.” I believe this comment needs to be considered. Only the neighbors know what events occurred between Mr. Roberts’ father and the surrounding neighbors. Enough apparently occurred that Kevin stated that a vendetta is owed. Who among us has never made a statement in the heat of an argument that they have not regretted? It is quite evident that everyone is very emotional. Perhaps a route for these neighbors, to begin healing hurt feelings, is too extend an apology to Mr. Roberts for what ever actions that may have occurred that caused distress to his father. Mr. Hoag on the Fox8 report admitted that he liked Kevin and that he is a good guy when you get to know him. If Faith is also one of the neighbors, perhaps she can also begin by reaching out to Kevin and extend greetings and an apology of some sort. Maybe even a gift of food.

I do not believe you are correct. Mr. Hoag stated that Kevin helped celebrate Christmas festivities for years and they were friends. Pictures of Kevin participating in the activities were also brought up. So at one time, everyone was happy and all occurring when he (Kevin) lived there. I hope your egg comment is not intended to mean that Faith might egg his house as an act of vandalism. Perhaps I misunderstood your comment and what you really meant was she could bring deviled eggs or egg salad as a gift of reconciliation.

All of us on the outside looking in can see that this vendetta has gone on long enough, whatever it is. You may never get the resolution or satisfaction that you desire - but you need to accept that. To carry it on like this for so long and any longer is so childish and very damaging to ones mentality. Life goes on and apparently has for everyone but those in that Roberts family. But to resort to cutting electric lines and wanting to live in a house to just make peoples lives miserable is pathetic, and again, scary. Get some help. Yes, he does need it, IMO. The AKA Adolph was comparing someone with hate to CERTAIN "good Christian" neighbors of Crown Point Circus that want to exile and egg a man for maybe wanting to watch the Cowboys game on Thanksgiving without worrying about the house burning down.

I will be glad when this is over. every neighborhood always has that neighbor who goes out of his way to complain about silly things, and this Mr Roberts seems to fit that guy well. all of the kind and generous people on the street try to bring joy to as many people as they can, by setting up such beautiful lights spending untold hours and wattage, all the while collecting donations for others.
And what do they get for a thank you, someone who moves in right next door who vowed to make their lives miserable. So thank you Mr Roberts You have brought much embarrassment to our city with your pettiness

Pettiness? Complain about silly things? Mr. Roberts’ complaint is ultimately in regards to Illegal fireworks display being conducted next door. He has asked for this activity to stop for years. The city did stop them in 2011. If the city stopped the fireworks display then, why did Mr. Hoag continue on this year? He asked for and received approval from the Mayor and the city even deployed two city policemen to monitor this illegal activity. What recourse did Mr. Roberts have but to bring it to court? Fighting city hall is not easily done. The city officials are ultimately to blame for their blatant disregard of Ohio law. Please read my earlier post. Go visit the web sites I reference. I believe everyone; including Mr. Roberts, applauds the donations being made to those in need. However, collecting the donations whilst conducting an illegal activity is no excuse. I agree with you it will be great to put this all behind and hopefully some peace, and possibly friendships, can be restored. So if you are going to thank Mr. Roberts, thank him for taking the heat for bringing out the fact that Strongsville city officials need to be educated in what is lawful. Perhaps they need to be brought up on charges of conspiracy. Why should Mr. Hoag be the sole individual, who may yet, have to face charges? So if you feel the need to thank someone for the embarrassment to the City, thank the Mayor and other city officials.

One thing Kevin Roberts has done is probably added more traffic to the street - now, for his next Thanksgiving dinner and all holiday season long. People like to see where these disputes take place and where a person lives that they read about.
For sure more people are going to stop and gaze at this guys house and know this is where the Grinch lives. I can see it now, all those fingers pointing out of the car windows as they drive by next year - hey, isn't that where that guy lives who is like the Grinch? Or is it Mr Scrooge? Bah-humbug!!!

I It is not my wish to see Mr. Hoag incarcerated, fined or both. There is no right or wrong here to take under consideration. It is wrong. However, I certainly do expect city officials to uphold the laws of the state of Ohio. If they refuse, I expect them to be held accountable. Perhaps even in a court of law.
Mr. Roberts is not able to charge Mr. Hoag with criminal activity and have him brought to criminal court. That is the job of our LAW INFORCEMENT. What he can do is bring it to their attention. He did, including the Fire Chief. This is why I reference city officials.
If all this does result in more traffic to see the Christmas displays this year, hopefully that means more donations! I suppose a thank you to Mr. Roberts would be in order.
By the way, the “Grinch who stole Christmas” is a beloved story. I’m sure you know it well. Referring to Mr. Roberts as a “nut job”? Whose heart is really 3 times too small now? In a previous post I mentioned making statements in the heat of an argument and later regretting it as an occurrence that everyone has experienced. I’ll consider your verbal attack on Mr. Roberts’ character as your example.

I’m taking a break from doing taxes so I will reply only this last time to Lyn and Kim L or others whose comments are not reasoned. I do not wish to attempt having a rational conversation with someone who cannot keep from verbally attacking a person.

My name is indeed Paul and I am not related to Mr. Roberts, either by blood or marriage. My knowledge is based on what I have read, seen on television news, or experienced.

I have presented some rather strong comments based on facts, and have substantiated my comments by providing links, when possible, for people to go look up for themselves. The law is the law. If we elect individuals who will not uphold the laws should they remain in office? No one is above the law.

Mr. Roberts is being persecuted without cause. Has he done anything unlawful? NO and I am not aware of any actions that he has done that are unlawful. He has asked city officials to uphold the law and they refuse to. Obviously, you and others do not care for him. You all should take a lesson from Mr. Hoag. He stated that he likes Mr. Roberts and has no animosity towards him. Why then do you and others?

If you wish to continue, I will be more than happy to answer, but only once you apologize for your verbal attacks to Mr. Roberts, and you present a logical and lucid comment. Also, when time allows me to. Now back to doing taxes!

Paul you keep talking in circles
you post that "Mr. Roberts is being persecuted without cause" but yet Mr Roberts admits to living on the street " just so he can make the neighbors' lives as miserable as possible."
Also you keep bringing up fireworks laws which have nothing to do with this .....no tickets were issued...... this is small claims court ..... do you understand how small claims court works ......Mr Roberts has a small claim (under 3000.00) for damage to his property (which he has a 305.00 ESTIMATE for gutter and yard cleanup)
that leaves 2700.00 for what pain and suffering which he will never get (why) because of MR Roberts admitted to in court which again the only reason he lives on the street is " just so he can make the neighbors' lives as miserable as possible." the judge is going to rule on the civil matter only ....not issue a warrant for the mayors or any who lit fireworks arrest ...what do you think the judge is going to suggest to the Berea prosecutor that they pursue criminal charges against the mayor for giving his permission to shoot off 10 whole minutes worth of (*lame by all standards) of fireworks that would be enjoyed by 35,999 people and despised by only 1

So, again - WHAT DID THE FIRE CHIEF SAY? You can't make that statement and not back it up. You said you were including him when you were referencing city officials when you said "The city officials are ultimately to blame for their blatant disregard of Ohio law." So, I assume you have first hand knowledge since you reiterated this to make your point, and can now back up this statement. And I'm not talking about after the fact - how is he to issue a permit or give his approval without being asked first?

You wouldn't know what the fire chief knew or not unless you were involved!

As for the nutjob being persecuted - he does have a personality disorder, IMO, that has resulted in this frivolous lawsuit - he admitted he has this obsession with tormenting the people who live on the street. The stuff introduced into evidence about sis not being able to leave and dinner being ruined is laughable and a waste of court time. So, the fallout on him is his own fault. The fireworks part does not belong in small claims court - and you know it by reading the links I gave you, which you later copied in your own comments.

I don't know Paul, but his take is pretty much spot on. I recently retired from the Strongsville Fire Dept. after 26+ years. I was following this whole issue out of curiosity, and that led me to call my former co-workers in the fire prevention bureau. Bottom line: the fire department was never officially consulted in regards to this fireworks display. They "unofficially" knew it was going on, but no inquiries regarding a permit were ever made, by either Mr. Hoag or Mayor Perciak. I was told that if formal permission had been requested, it would have been denied. Both the lack of a professional/licensed exihibitor and the proximity to homes in the area would have been major issues. If you don't believe me, please feel free to contact the SFD fire prevention office at 580-3225. My apologies to those guys, but this dis-information needs to be cleared up.

So, if you wish to read between the lines, this part of this story boils down to politics.

The permission of fireworks were granted by the mayor and its pretty clear legally he needed the fire marshals permission also ...........but it has NOTHING to do with the civil lawsuit for 3000.00 worth of damage

Maybe he (Mr Roberts) is so frivolous that he wants restitution for his ink cartridges used for his evidence, probably his VHS tape(s) too, his time to do the clean up, for his sister for her's and her dog's emotional distress. Who knows? Maybe he wants the extra $2695.00 just to teach Dan Hoag a lesson. So sad, to say the least. If Mr Roberts get's even a penny, I will loose my faith in the court system.

I think all here who are appalled by Mr.Robert's & his sister's behavior & comments need to realize that we are dealing with some very emotionally disturbed people.Whether or not the magistrate rules that proper protocol was not followed & issues damages to be paid or not,Mr. Roberts & Co.(there are so many "personalities"/aliases of he& his sister supporting each other it's hard to know who is legitimately commenting) will probably see it as a "victory" in their vendetta-for a short while. However,that won't satisfy them for long & they will find something else to make his neighbors miserable,because that appears to be his life's goal.This whole fireworks thing is just the tip of the iceberg in the mind of 2 emotionally disturbed siblings who enable each other.There is obviously underlying pain related to the loss of their father. People should not be joking or calling him names because it may push him to the point of acting out on his mission of hurting others(be it emotionally or physically). The police will not protect the neighbors because until he actually does something that breaks a law(in which case it may sadly be too late) they cannot act. This represents what is wrong in our country in regard to treatment of the mentally ill/disturbed.This is why many recent tragedies happened.People knew there was something wrong w/these people but the laws don't support doing anything about it until what they do is considered a criminal act-and by then it's usually too late.

The best the neighbors can do is steer clear of him at all costs. If there is ever just cause ,he can be committed for a 24 hour hold should he exhibit any strange or potentially harmful behavior or if he breaks the law by damaging their property or other offenses. Keep a log of any & all suspicious behavior & activity & be vigilant about reporting it to the police. He appears to be doing that with his neighbors,monitoring their moves. Finally, pray for Mr.Roberts & his sister and try to be kind-they are not well people. I feel for these neighbors ,but they have to learn to not let him have the control-they should just keep on doing what they do(even if it means no fireworks) & think of the greater good. Reminds me of an old Jackson Five song "One bad apple don't spoil the whole bunch..."-don't let him spoil all the good you do or your fun.

Now let me just say, i lived on crown point all my life. No one was ever in danger, the firewprks were never a problem. Kevins dad was a very nice old man untill about 2001 i believe it was... I was selling cookies and he yelled at me to get off his property and told me the bank was closed... This came from outta no where... He always had been so nice...
But in my opinion, kevins father didnt become that way on his own... I believe kevin rubbed off on him. Kevin has always been crazy and seriously messed up in the head. Atleast for the 23 years ive known him....
But regardless, i think this is all ridiculous and everyone on here whos tryin to make kevin look like a victim... You all are just idiots.

No one on the street has to worry about recording, as I have stated before, Kevin has two video cameras set up in his windows. Everyone should be sure to wave and smile as you pass his house because you as well as your children are being video taped as well. The disturbed part of it is that he normally only makes the videos he has 'adapted' public. He recently tried to pass a video off to one of our local t.v. stations and evidently forgot he left his comments on it. It is beyond disturbing. The television station laughed and handed it to Dan Hoag stating, "we don't want this trash".
And btw Steve, you evidently have no place to speak of 'good christian people'. You have done nothing on here but refer to Hitler and use 'not so witty' names to describe myself and my neighbors. Since everyone clearly knows who I am why not post your full/real name? Or are you ashamed of your previous, albeit false comments?

Well you are right that this could potentially take a turn for the worse. Especially with this neighbors background. Non of you know the extent of his background. But PLEASE don't let it stop you from seeing the lights. Thanks to the people who visited our street we were able to donate over $4000 to the family of an 11 year old with terminal brain cancer. Unfortunately just over a week ago he lost his battle but the donations possibly lightened the monetary burden his parents are going through.....just a little but at least something.

One day I would like to know this background. I've been coming to see the lights for many years, including last years kick off (my first) and am NOT going to let this NUT JOB stop me. Maybe this year you can put up a sign that says "The Grinch Lives Here" and have an arrow pointing towards Mr Roberts house. Sorry to hear about the little boy's passing. Maybe this year this whole sad affair will bring more people and bolster donations, so more good can be done by the neighborhood's donation. I'm just hoping that fireworks will be part of this years kick off. I think they really made last years FANTASTIC!!!

I saw this news story as well. It was made very clear that this fireworks show was put on by an exhibitor licensed by the state fire marshal, with the additional approval of the local fire department. And, it was conducted in the middle of a largely rural area, which certainly was a factor in approval being granted by the local fire department. Big difference in circumstances.

Well it's about time!

From Fox 8 News

BEREA, Ohio– A judge has dismissed a man’s claim that his neighbor’s fireworks display ruined his Thanksgiving dinner.

However, the judge did rule that the neighbor must pay the man cleanup costs from the fireworks debris that fell on his property.

Kevin Roberts of Strongsville sued his next door neighbor, Daniel Hoag, after he claims a fireworks display this past Thanksgiving ruined his holiday dinner.

The lawsuit claimed fireworks debris fell on Roberts’ home and yard, and a family member suffered emotional distress from the crowds of people blocking the driveway to watch the display.

Monday, a judge ordered Hoag to pay just more than $300, plus court costs and interest, to the plaintiff for the cleanup costs.

But the judge threw out the claims for emotional distress and spoiling Thanksgiving dinner.

Hoag said he has received a tremendous outpouring of support and donations and the money left over after the settlement will be given to charity.

I believe the court should pay the interest for taking so long to make it's decision.
