Police release 'use of force' report from Saturday's shooting

New details released in the  Saturday afternoon indicate the suspect drove his car at the officer who shot him.

A "use of force" report identifies the officer who fired the shots as Detective Jason Miller. He remains on paid administrative leave early this week.

Both suspects in the incident were charged today. Lawrence McKissic, 27, of Cleveland, who was shot twice by Miller about 2:45 p.m. Dec. 3, was charged with five counts, including trafficking offenses, drug possession, tampering with evidence and possession of criminal tools.

His injuries were not life threatening. 

Lorenzo Dobyne, 24, of Middleburg Heights was charged with four counts, including trafficking, drug possession and having criminal tools.

Both have previous arrest records.

The newly released report says Miller and Detective Steve Dzurisin were "engaged in a joint narcotics investigation which led them to the parking lot of ."

It doesn't identify the other agency, but several Cleveland police officers were at the scene on Saturday.

During the investigation, officers spotted two suspects who were wanted in connection with the sale and possession of crack cocaine.

In an effort to avoid a road pursuit, officers approached the suspects' car to make the arrests.

An officer from another department pulled his vehicle behind the suspects' car, went to the passenger side and removed Dobyne.

Meanwhile, Miller approached the driver's side, identified himself and told the driver -- McKissic -- to stop, put the car in park and show his hands.

The suspect did not comply, the report says. "He instead began driving his vehicle forward toward Detective Miller, while at the same time reaching into his inside coat pocket. At this point, Detective Miller feared that the suspect was reaching for a weapon."

Miller "feared for his life and in order to stop and incapacitate the suspect, had no choice but to respond with the use of his firearm," the report said.

The arrests and shooting took place in an outlying area of the parking lot. At least nine shots were fired, judging by the number of bullet holes in the car windshield, but some witnesses said they heard more.
